    If you want a solicitor to attend a mediation as well, contact us to get a fixed price.

    Mediation sessions can be conducted face to face at our Sydney or Darwin office or via Zoom.

    If you come to an agreement at the mediation, we can formalise them if appropriate, so you can then make them legally binding once sealed by the Family Court of Australia (Consent Orders).

    We charge just $1,600 incl GST fee for that work.

Hopefully, your matter will settle early and you can finish things up with your children and financial matters with  consent orders, parenting plans or a binding financial agreement without going to Court or not long after if you need to go.

  • Interim affidavits - up to 10 pages from $2200

    Affidavits are very important in court matters. The Court relies on written evidence, not verbal, so it's imperative your affidavit is factual and detailed. There are very specific expectations from the Court as to what information they want in your affidavit to assist them in making a decision about your matter. Compiling the best affidavit possible is to your advantage and what we do best!

    Interim affidavits are limited to 10 pages in Division 1 or 20 pages in Division 2 

  • Trial Affidavits $350 ph

    If your matter goes to trial it will be vital to present a fully inclusive affidavit of all the evidence you wish to be heard in your matter. This affidavit needs to reflect your narrative in a factual manner and may include reports from professionals, child services, police, mental health specialists and others. This affidavit is to be presented to the Court as a comprehensive and clear statement of matters particular to your family law matter. 

    Trial affidavits are usually between 20-40 pages.

  • Case Outlne from $1495

    This document must be filed in accordance with any trial directions made by the Court.  Case outlines can be requested for both interim and final hearings.

  • Contravention Application from $1800

    A Contravention Application is  made to the court claiming that another party is not in compliance with a court order. The aim of bringing a Contravention Application is to get the other party to comply and  sometimes, to get a remedy. An example of not following Court Orders would be a parent who is not  following  the court orders made about children spending time with one parent.  An affidavit will also be needed to filed with the Contravention application.

  • Recovery Order                    from $1800

    Under the Family Law Act 1975, a child recovery order is an order of the court requiring a child to be returned to either the child’s parent, an individual who has a parenting order that states who the child lives with, spends time with and communicates with that individual, or an individual who has parental responsibility of the child.

    For serious matters, child recovery orders can be processed immediately. For less serious matters, they can take a week or more. However, the court generally prioritises cases involving children and schedules the court date as soon as possible.

  • Attending Mentions             $350 ph

    What happens at  a first mention family court?

    This is basically a short period of time before the judge where he, or she, checks that the people involved in the case have done all that they need to do in order to progress to the next stage. You may feel more confident having a lawyer with you on the day. Mentions are more often than not, done via video link.

  • Preparation for Mediation & Legal Advice     $350 p.h

    You may choose to attend your parenting and/or property mediation unrepresented but we do encourage you to be fully prepared to get the best outcome. We will help you identify the issues at hand, and discuss options around settlement and the process if the matter cannot be settled. Full disclosure is necessary at mediation so it is imperative you attend with a fully transparent portfolio which has been put together with the assistance of your lawyer in order to achieve a great result.

  • Attending Mediation from $350 ph

    The role of a Lawyer at a mediation is quite specific in that they attend in a ‘hands-off’ advisory capacity. In this setting, lawyers need to restrain their natural instinct to do the talking and negotiating on behalf of you, their client. The mediator is the person faciliating the mediation.

    Your lawyer attending mediation is there to offer general legal advice to you, usually in a private session, of  the possible settlement options canvassed. Lawyers will often ‘reality test’ proposals for settlement to see that they legally meet your requirements and also those needed for a court to enforce the decision. Your lawyer is not there to influence the way the mediation is conducted, but to ensure that you understand the legal ramification of any agreement reached..
